Protruding branch of the neighbor’s tree

When I visited my uncle’s house in California, I immediately noticed the big branches of a plum tree that was fruting heavily. My uncle said that I can pick the fruits because the branch was trespassing on their property which means it is legal to claim those fruits.

Yesterday when I was needing Calamansi, I went to the fence to check on the Calamansi tree of our neighbor. By the way, Calamansi is a small citrus fruit that is very sour and is an alternative for lemon or lime. Some branches of the Calamansi tree were over the fence and hanging inside our boundary. I picked 5 fruits that I need. And then I said to myself that those fruits were for us since the neighbor doesn’t pick Calamansi ever since.

  1. You would also be entitled to trim any branches that have encroached on your side of the fence. However, were you to start cutting away at any roots on your side of the fence, that could be a different matter.
