Making writing sites better, an apology and an explanation of why copy right and right of first publication are important

First, I did want to explain the mistake I made yesterday fully. Let’s start with I am sorry I added a poll question that was not disclosed and the poll question was wrong. I apologize for any confusion wholly caused by me. I do not think Private Messages on the site are false. I just think we need a level of projection there as well as in the comments on posts. I would like to add a report button for PMs on the site. I have over 300 private messages since joining the site. I would only report two authors for words that were mean or unkind. I have had many wonderful conversations in the PM system of the site, and do not feel that PMs are bad, just some don’t respect others in private messages.

The other thing I wish to point out is that my attorney advised me to add the disclaimer to my posts. I had sent him some posts from the site, and he informed me based on that to point out that I do not talk about people unless I explicitly mention them by name. Based on that if you wish to know the two authors that I have blocked and who I would like to report the PM’s of, send me a PM and I will tell you who they are. He also pointed out that while I own the copyright of all things I create, the site owns what is called the right of first publication. Based on the decline and fall of the site Niume, he advised me to add copyright specific to my posts, so that I can claim my posts and republish inside of the as much 180 time period they will remain in search engines.

I would also like to note that if you don’t use copyright publications on Hubpages expressly, they claim the right of first publication and first copyright. They do allow the option to copyright your works, and if you publish there, I highly recommend you take that right. By default, you own your copyright here on this site. But the website does maintain the first publication right. As my attorney said to me in an email, what does it hurt? So I added the additional. I am not saying that this adds anything other than protection for my work, should this or any other site I publish on goes out of business. This is whole to allow me to republish my posts before they clear the search engine cache. Which sadly can take as much as 180 days.

  1. I used to watermark my photos with a copyright and signature. Since my real camera broke, I no longer take photos in RAW, so I dropped the mark..
I also make them so noisy and small that no one would steal them. Anything bigger than a thumbnail and they become too fuzzy to use.

    • the disclaimer was my attorney’s shall we say the rather angry response to my posts that I sent him. it does absolve you from some things.

The interesting arguments raised by Carol and Pam on the reality of photos and art being “stolen” is extremely disturbing.

  3. I know people pinch other peoples achievements and information on the internet, and they are in fact thieves.
Often with art work, artists experience, theft, and also are cheated out of their funds.
In our case, what people do, is not to buy our work, tell us we are useless, and 2 weeks later use our ideas and say it is all theirs.
Of course we have no defence, because they don’t follow exactly, but it is another form of theft that cant be proven legally.

Well, it is called plagiarism and no one can ever prove it.

Good on you for the copy write protection and I hope it works for you.

  4. The information about first publication/copyright is very useful.
I love disclaimers, but they can be a bit tricky. I personally avoid talking about other people at all, unless it’s something positive.

    • i agree with your position. I don’t talk about people unless i have explicitly asked them if it is ok (the two folks that reached out to me about ads is an example of that) or that I expressly mention them by name.

if those two criteria aren’t meant I am talking generically. I agree!

  5. I haven’t sent or received anything thru PM for quite a long time now. But this is great information about copyright and right of first publication, Doc.
Frankly speaking, I didn’t think about these so much. As long as I don’t copy anybody else’s work without mentioning the source.

    Thanks for this info.
