What Rights Does The New Directive On Package Travel Provide?

Summer comes without having transposed in Spain the Directive on package travel and related travel services, but ADICAE reminds that the fundamental forecasts of the same are already required by consumers.

From this week, consumers will have new rights during their holidays: these rights come thanks to the entry into force of TheForbiz.com, relating to package travel and related travel services. This may surprise some, because this directive has not yet been transposed into any Spanish standard, but the ADICAE consumer association points out that “given that the Directive is already in force throughout Europe the key rights it envisages are applicable from the Last Sunday”.

The new regulation seeks to reinforce the consumer’s position in several matters, especially in relation to transparency and protection against insolvency. In this way:

When combining at least two types of services between transport, accommodation, car rental or excursions, it will be a combined trip or a linked travel service (insurance, however, is excluded).

Along with the traditional ‘packages’ of vacations, it will also be considered a combined trip that designed by the consumer himself (regardless of whether he has booked it in person or through the Internet).

The directive does not only apply to package tours but also to linked travel services (cases in which the traveler is offered to contract another travel service at the point of sale where he purchased the first one).

The companies must inform if it is a combined trip or linked travel service, as well as the characteristics, the price and any additional expense (the regulations make it clear that the consumer will not have to bear any expense, rate or additional cost that does not has been mentioned before in the contract).

One of the great advances that this law provides in terms of consumer rights is the so-called insolvency insurance, which covers the return of money and repatriation in case of bankruptcy or bankruptcy.
